More on Illegal Payments to Landlords by Section 8 Tenants

We last visited this topic in August, 2025.  Landlords who show up demanding more money than specified in official HUD contracts are likely acting illegally. How can you fight back?

Section 8 Landlords Can’t Make Their Own Rules

Your signed rental agreement as a Section 8 recipient who is now an established tenant is very clear. You are not required to pay anything beyond what is specified in your rental agreement.

Examples of Section 8 Landlord Payment Issues

  • Your landlord asks you to “lock in” your rental agreement with a 1-time fee (this is voucher fraud);
  • You are asked to take responsibility by replacing a broken stove. HUD rules require your landlord maintain living conditions in your rental unit. Appliance repair provisions must be noted in your contract;
  • You are asked to pay (possibly discriminatory) security deposits or utility bills not specified in your contract ;
  • You receive demands for extra payments for parking, furniture rental, amenities, fees etc. not specified in your contract;
  • Your landlord is charging Section 8 tenants higher-than-market rates for your housing compared to non-Section 8 neighbors;
  • Your landlord requires extra payments be made in untraceable cash transactions

Do Section 8 Landlords Face Penalties for Infractions?

Yes. Numerous recent cases involving problems like these  brought resulted in lawsuits being brought by tenants against their landlords.  Landlords who violate their HUD contracts and demand side payments from Section 8 tenants can pay a heavy price in court. They could also lose the ability to offer Section 8 housing.

What if my Landlord is Demanding Extra Payments?

Study your rental documents to determine if your issue is addressed. Determine if your own actions resulted in a request for extra payments. Did a pet you are not permitted to have damage the carpet?
